Members need to stand aside from decision-making when a conflict arises between their role as a Member of the Committee and any private or other external interest they might have. This note is provided as a reminder to Members to review the matters on the agenda and assess and identify where they may have a pecuniary or other conflict of interest, or where there may be a perception of a conflict of interest.
If a Member feels they do have a conflict of interest, they should publicly declare that at the start of the meeting or of the relevant item of business and refrain from participating in the discussion or voting on that item. If a Member thinks they may have a conflict of interest, they can seek advice from the Chief Executive Officer or the Manager - Democracy Services (preferably before the meeting).
It is noted that while members can seek advice the final decision as to whether a conflict exists rests with the member.

The minutes of the previous Motutangi Drainage Area Committee meeting are attached to allow the Committee to confirm that the minutes are a true and correct record.
That the Motutangi Drainage Area Committee confirm that the minutes of the meeting of the Motutangi Drainage Area Committee held 17 April 2023 are a true and correct record. |

Local Government Act 2002 Schedule 7 Section 28 states that a local authority must keep minutes of its proceedings. The minutes of these proceedings duly entered and authenticated as prescribed by a local authority are prima facie evidence of those meetings.

The minutes of the meeting are attached.
Far North District Council Standing Orders Section 27.3 states that no discussion shall arise on the substance of the minutes in any succeeding meeting, except as to their correctness.

To update the Motutangi Drainage Area Committee since the previous meeting.

The Motutangi Drainage Area has had drains machine cleared in accordance with Resolution 2023/2.

tĀHUHU KŌRERO / Background
The Motutangi Drainage Area Committee was formally established at the 26 February 2015 meeting of the group previously known as the Northern Advisory Drainage Committee.
Prior to the formal establishment of the individual drainage area committees, there were meetings of the Northern Advisory Drainage Committee.

2.1 Works undertaken during 2023/2024
Spraying
The spray work in the Motutangi Drainage Area have not been completed to date. However, a local contractor having recently completed the Kaitaia Drainage Area works is available to quote and spray this scheme.
Machine Clearing
Machine clearing has been completed for the 2023/24 period.

2024/2027 Proposed Budget
From the above tables, it is apparent that the reserves balance within the Motutangi Drainage area remains high. It is recommended the reserve funds be utilised to remediate and bring the drains to good standard. Consideration should be given to reducing the rates for the 2024/25 rating year given the current reserves funds available. The reserves funds would be utilised in 2024/25 for the spray and drain clearing works.

Rate Implications
Rating implications will be consulted on at the earliest opportunity. Expressions of interest close on Monday 11th March, one working day prior to the agenda deadline and were therefore unable to be included in this report. To provide Motutangi Drainage Committee with an overview of outstanding Committee decisions from 17 April 2023.

· Open resolutions are a mechanism to communicate progress against decisions/resolutions.
· Open resolutions are also in place for all formal elected member meetings.

1) TĀhuhu kŌrero / Background
At the 17 April 2023 Motutangi Drainage Committee Meeting the Committee requested an action sheet update report be included in all future Drainage Committee Meetings. Any resolution or decision from a meeting is compiled on an open resolution status report, to capture actions trigged by Kaitaia Drainage Committee decisions. Staff provide updates on progress against tasks that are not yet completed.

The outstanding tasks are often multi-facet projects that take longer to fully complete. Where a decision differs to the recommendation of staff there may be unintended consequences or challenges that take longer for staff to work through.
