This note is provided as a reminder to Members to review the matters on the agenda and assess and identify where they may have a pecuniary or other conflict of interest, or where there may be a perception of a conflict of interest.
If a Member feels they do have a conflict of interest, they should publicly declare that at the start of the meeting or of the relevant item of business and refrain from participating in the discussion or voting on that item. If a Member thinks they may have a conflict of interest, they can seek advice from the Chief Executive Officer or the Team Leader Democracy Support (preferably before the meeting).

5.1 Representation Review 2021 - Hearings of Submissions on the Initial Proposal

To receive and hear the submissions relating to the 2021 Representation Review Initial Proposal for representation arrangements for the 2022 triennial local government elections.
WhakarĀpopoto matua / Executive Summary
· Council adopted its initial proposal for formal consultation on 12 August 2021.
· Submission period ran from 20 August 2021 to 1 October 2021 during which time 128 submissions were received.
· There are 19 submitters who wish to be heard.
That Council: a) receive and hear the submissions relating to the Representation Review Initial Proposal for representation arrangements for the 2022 triennial local government elections. b) accepts for consideration by Council, submissions identified as being received after the close of the submission period (Friday 1 October 2021) up until 8am Monday 4 October 2021. |
1) TĀhuhu kŌrero / Background
The Local Electoral Act 2001 (LEA) requires local authorities to undertake a review of their representation arrangements at least once every six years to ensure the arrangements provide fair and effective representation for communities.
Council last reviewed its representation arrangements in 2015 which took effect for the 2016 and 2019 triennial elections.
The LEA 2001 prescribes the process and timeline that councils are required to follow when undertaking a representation review. Prior to undertaking the review, two earlier decisions were made by Council – to adopt the Single-Transferable Vote (STV) electoral system and to establish one or more Māori wards.
On 12 August 2021, Council adopted, pursuant to sections 19H and 19J and clauses 1 and 2 of Schedule 1A of the Local Electoral Act 2001, the Initial Proposal for public consultation on its representation arrangements for the 2022 triennial local government elections and authorised staff to prepare the Initial Proposal for consultation with the community and invite the public to make a submission on the Initial Proposal.
Public notice of the Initial Proposal was given on 20 August 2021, a copy of which is attached as Attachment 1. Council’s Initial Proposal was released for public consultation between 20 August 2021 and 1 October 2021. A copy of the Initial Proposal booklet outlining the proposal and the representation review process is attached as Attachments 2 and 3 (noting that its format is for printed folded booklet form).
128 submissions on the Initial Proposal were received. Three (3) submissions were received between the closure date of Friday 1 October 2021 and 8am on Monday 4 October. Nineteen submitters indicated that they wished to speak to their submission. Any submissions received addressing matters of policy or principle that are outside of the representation review process (e.g. the decision to establish Māori wards or the formula for establishing how Māori wards are created) are ‘out of scope’ and unable to be considered and as such, some may withdraw their request to speak to their submission prior to the meeting.
In considering the submissions received, Council needs to identify and consider the three legislative processes of identifying communities of interest and ensuring these communities of interest have fair and effective representation.
Council is required to consider any submissions it receives on its Initial Proposal, and then either confirm or amend the Initial Proposal and give public notice of its Final Proposal within six weeks of the closing date of submissions (i.e. by 12 November 2021). The Final Proposal is subject to rights of appeal and/or objections which will be considered by the Local Government Commission.
